Over the past several years, state governments have been enacting new privacy and data security legislation at a rapid pace. Often, these new laws constitute modified versions of the comprehensive approach to privacy regulation pioneered by the EU’s General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). These laws are never identical, and organizations doing business on a nationwide scale have struggled to rationalize a complex patchwork of sometimes contradictory legal obligations. As a result, pressure is mounting on Congress to clear the field with federal legislation.
At the same time, the corporate world is more attuned to privacy and data security concerns than ever. The Annual Global CEO Survey conducted by PricewaterhouseCoopers in January and February of 2021 found that almost half of United States CEOs plan to increase their investments in cybersecurity and data privacy by up to nine percent over the next three years, while thirty percent plan to increase investments by ten percent or more. Moreover, forty-two percent ranked cyber and data privacy second among eleven areas of impact and value.
