Privacy Notice

Introduction

Spengler & Agans, PLLC (“SA”) respects your privacy. This Privacy Notice (“Notice”) is designed to inform you about the information we collect from visitors to our website and how we use that information. Please read this Notice carefully. If you do not agree with our practices, you may choose not to use our website. However, if you do use our website, you are agreeing to our practices as set forth in this Notice.

Scope

This Notice applies to information that we collect online through our website, and it does not apply to information that we collect through any other means, such as phone calls or email messages. Furthermore, this Policy does not cover information collected by any third-party website or third-party application that may link to our website, or that can be accessed from our website.

Our website is powered by Squarespace, and most of the information we gather from visitors to our website is gathered through tools made available by Squarespace. If you want to learn more about Squarespace’s own policies and practices regarding the processing and use of your data, as collected by Squarespace through your interactions with our website, you can view the Squarespace privacy notice here. For purposes of the Squarespace privacy notice, we are the “User,” and you are the “End User.”

Information We Collect from Website Visitors

We collect two categories of information from website visitors. The first could be described as “website usage information,” encompassing usage details, IP addresses, information collected through cookies, and other information of a similar technical nature. We collect that information automatically through your use of the website. The second category of information we collect from website visitors is the information that users provide to us through their voluntary use and completion of our contact or newsletter sign-up forms, and other similar interactive features. Each category is addressed in more detail below.

Website Use Information (Collected Automatically)

As mentioned above, we automatically collect certain types of technical information from visitors to our website, including:

  • Technical Information. When you visit our website, we collect technical information such as your Internet Protocol (IP) address, your device’s operating system and browser type, location data, and the pages of our website that you visit. Most browsers automatically transmit this type of information to websites, and we collect this information in order to administer and manage our website, to ensure that it functions properly for different users with different browsers and operating systems, and to obtain and review website-related statistics and information so that we can provide a better product.

  • Cookies. Like many other websites, our website uses Cookies. Cookies are small text files that are downloaded to the browser of a computer, tablet or smartphone used to visit a website. Some of the Cookies we use are strictly necessary in order for our website to function, and we have elected to use others help us monitor our website’s performance and usage trends. The latter—the Cookies we use to monitor our website’s performance and usage—are disabled by default; we only start to use them when you click “Accept” on the Cookie Banner that appears at the bottom of your screen upon your first visit to our website. For more information on the Cookies we use, you are welcome to visit the Squarespace page on the topic.

Information that You Provide to Us

We may also collect information about you through our website if you provide that information to us voluntarily by completing one of our contact or newsletter sign-up forms or another similar interactive feature. In that case, the information we collect will be the information that you provide to us, often including your name, email address, and a short description of your issue. We encourage our users to refrain from including any confidential or sensitive information in any web form submissions that they send to us, as web forms are an intrinsically insecure medium for communication. If you need to have a confidential conversation with us, a phone call or email is a superior choice.

How We Use or Process Your Information

We use the technical information that we collect through your usage of the website to monitor and analyze the performance of our website and various pages within it, and, based upon such analysis, to improve or update our website.

We may use information that you voluntarily provide to us through our contact or newsletter signup forms, or another similar interactive feature, for any of the following purposes:

  • To provide invitations to and registration and other information about seminars, workshops, conferences, and other firm programs, or to provide information, newsletters, publications, blog updates, social media and marketing information;

  • To deliver any requested information, products or services, or to provide you with requested customer support;

  • To notify you about changes to our website, changes to the information, products or services we provide on or through our website, or changes to this Privacy Policy; or

  • To perform any other processing that we describe when you provide the information and for any other purpose with your consent.

Sharing Your Information

We may share the information that you provide to us on a confidential basis with contractors, vendors, or service providers—such as mailing list operators—that support our operations and our website, but we will only do so for the purposes listed above.

We will not share or sell your information for any purpose with any other party. We will not use your personal data for making any automated decisions affecting you or your legal rights or for creating profiles other than as described above.

Security, Enforcement, and Lawful Process Exceptions

Notwithstanding any of the foregoing, we may use your information to respond to lawful requests for information through court orders, subpoenas, warrants and other legal process or obligations; to enforce our website’s terms of use or for the establishment, exercise or defense of legal claims; to protect the operations of our law firm, or the safety, security and privacy of our firm, our employees and staff, our clients, and any affected third parties; and for purposes of fraud prevention, information security, and related matters.

Furthermore, notwithstanding any of the foregoing, we may share your information with courts, law enforcement authorities, regulators, attorneys or other parties when it is reasonably necessary for the establishment, exercise or defense of a legal or equitable claim, for purposes of an alternative dispute resolution process, or to meet national security and law enforcement requirements; to comply with a subpoena or court order, legal process, or other legal requirement or when we believe in good faith that such disclosure is necessary to comply with the law, prevent imminent physical harm or material financial loss; to investigate, prevent or take action concerning illegal activities, suspected fraud, threats to our firm, any of its lawyers, its staff or our property; or as necessary in connection with an investigation of fraud, intellectual property infringement, piracy or other unlawful activity.

Tracking

We do not currently collect personal information about your online activities over time and across third-party sites for tracking purposes. We do not currently allow third parties to collect personal information on our website that could be used by them to analyze and store information about your online activities over time and across third-party sites for tracking purposes. As such, our website does not currently respond to any "DO NOT TRACK" signals that may be sent from your browser or device.
